Notice of Privacy Practices (HIPAA) Your Rights and Our Responsibilities Regarding Your Health Information This Notice of Privacy Practices describes how Everlight Hospice may use and disclose your protected health information (PHI) and your rights regarding your health information. Your Rights - Receive a Copy of This Notice – You may request a paper or electronic copy of this notice at any time. - Access Your Medical Records – You can inspect and request copies of your health records. We may charge a reasonable fee for copies. - Request Corrections to Your Records – If you believe your records are incorrect or incomplete, you may request an amendment. - Request Confidential Communications – You may request that we contact you at a specific location or by specific methods. - Request Restrictions on Information Use – You may request limits on how we use and disclose your information, though we are not required to agree. - Receive an Accounting of Disclosures – You may request a list of disclosures we have made of your health information, except for those related to treatment, payment, or healthcare operations. - File a Complaint – If you believe your privacy rights have been violated, you may file a complaint with Everlight Hospice or the U.S. Department of Health and Human Services (HHS) without fear of retaliation. How We May Use and Disclose Your Health Information - Treatment – We may use and share your PHI with doctors, nurses, social workers, chaplains, and other members of your care team. - Payment – We may share your PHI with insurance providers, Medicare, Medicaid, or other payers to process claims and receive reimbursement for services. - Healthcare Operations – We may use and disclose your PHI for quality improvement, staff training, compliance audits, and other administrative functions. - Required by Law – We will share your PHI if required by federal, state, or local laws, including reporting communicable diseases, responding to legal orders, or notifying authorities of abuse or neglect. - Business Associates – We may share your PHI with third-party vendors who provide services on our behalf, such as billing or IT support. - Family and Caregivers – With your consent, we may share relevant PHI with family members or caregivers involved in your care. - Disaster Relief – We may disclose PHI to assist in emergency response efforts or disaster relief situations. - Research and Public Health – We may use PHI for research purposes if you provide authorization or if permitted by law. - Organ and Tissue Donation Requests – If applicable, we may share PHI with organ donation organizations. - Law Enforcement and Government Requests – We may share PHI for law enforcement purposes, national security concerns, or military operations. - Workers’ Compensation – We may share PHI to comply with workers’ compensation laws. - Deceased Patients – We may disclose PHI to a coroner, medical examiner, or funeral director as necessary. Your Choices - Fundraising Communications – We may contact you for hospice-related fundraising, but you may opt out. - Marketing and Sale of Information – We will never sell your PHI or use it for marketing without your explicit permission. - Psychotherapy Notes – We will not disclose notes from private counseling sessions without your written consent. Our Responsibilities - Maintain the privacy and security of your PHI. - Notify you in case of a breach that compromises your PHI. - Follow the terms of this Notice of Privacy Practices. - Provide a copy of this notice upon request. Changes to This Notice We reserve the right to change this notice at any time. Changes will apply to all PHI we maintain. The updated notice will be available upon request and posted in our offices and website.
